RE: Request investigation of taxpayer funds used for in-state tuition for Illegal Aliens and prenatal care benefits/servcies provided to Illegal Alien women.

Dear Mr. Foley:

#1: In-state Tuition for Illegal Aliens: LB 239 allows Illegal Aliens to receive in-state tuition which is subsidized by Nebraska taxpayers. During Feb. 1st, 2010 public hearing for LB1001 which is a bill to Repeal In-State Tuition, the chairman of the Education Committee, Sen Adams admitted the legislature knew at the time they passed and over-rode Gov Heineman's veto that they would not be in compliance with federal immigration laws. Attorney Kris Kobach gave testimony as to the specific federal laws and that allowing these "children" to get a college education would actually delay an Illegal Alien's eligibility for citizenship for 10 years nor would they be allowed to legally work in Nebraska, Atty Kobach also mentioned the lawsuit in this matter that was filed in Fairbury, Ne in January. Yet, the Education Committee has failed to advance LB1001 out of committee. I'm requesting an investigation to see if taxpayer funds are being abused and mismanaged.

#2: Prenatal care for Illegal Aliens has been provided to Illegal Alien pregnant women for "decades" according to policy - even though it was not in compliance with federal law. Once HHS was notified of this they issued service termination letters effective March 1, 2010. What I'd like to know is how much of taxpayer money has been abused and how many Illegal Alien women have been allowed to take advantage of this policy. Local media has been reporting on this for the past month and many of the articles clearly show that HHS was not in compliance but also have had the names and address of atleast 1,000 Illegal Alien pregnant women currently living in Ne but have failed to report their information to U.S. Immigration & Customs Enforcement. I'l like to see an investigation into this matter.
